Seller Sidekick Privacy Policy

1. About this policy and who we are

Seller Sidekick is a brand operated by the Trustee for AgentHype Trust (ABN 98 933 604 791), trading as AgentHype ("Seller Sidekick", "we", "us", "our"). This policy explains how we collect, use, hold, disclose, and protect your personal information, and the rights you have over it.

We are committed to handling your personal information in accordance with:

  • The Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs), which apply nationally across every Australian state and territory, as well as any relevant State or Territory privacy laws

  • The Spam Act 2003 (Cth)

  • The Do Not Call Register Act 2006 (Cth)

  • The New Zealand Privacy Act 2020 and its 13 Information Privacy Principles (IPPs), including the indirect collection notification requirements under IPP 3A that take effect on 1 May 2026

  • The New Zealand Unsolicited Electronic Messages Act 2007

Because we share leads with real estate agents in exchange for a benefit, we treat ourselves as bound by the Privacy Act 1988 (Cth) in full, regardless of our annual turnover, and we do not rely on the small business exemption.

This policy applies to information collected through our Facebook and Instagram lead forms, our websites and landing pages, and any related communications.

2. The most important thing to understand

Seller Sidekick connects home sellers with local real estate agents.

When you download one of our guides or request a home value update, you can choose to have your details shared with a local Seller Sidekick approved real estate agent so that agent can contact you. We only do this if you expressly consent by ticking the relevant box on our form. Your consent is optional. If you do not consent, we will still send you the guide you requested, and we will not pass your details to any agent.

This section is summarised here so you understand it clearly before you read the detail below. The full terms of how agent sharing works are in section 6.

3. What is personal information

Personal information is any information that identifies you, or could reasonably be used to identify you. This includes your name, address, phone number, email, and other contact details, in any format.

4. What personal information we collect

When you interact with Seller Sidekick, we collect:

  • Your name

  • Your email address

  • Your phone number

  • Your property address, suburb, or postcode

  • Any additional details you choose to provide (for example, your selling timeframe, property type, or reason for selling)

  • A record of the consents you give, including the date, time, wording, and method of consent

  • Technical information including your IP address, device type, browser, and the ad or page you arrived from

We do not seek to collect sensitive information (such as health, racial, political, or financial information). If you provide it voluntarily, we only use it for the purpose you provided it and only with your consent.

If you do not provide the information we need, we may not be able to deliver the guide, service, or agent connection you have requested.

5. How we collect it and why

We collect personal information lawfully and transparently, primarily directly from you, when you:

  • Complete a Meta (Facebook or Instagram) lead form

  • Download a guide or request a home value update on our website or a landing page

  • Contact us by phone, email, or message

  • Participate in a promotion or offer run by Seller Sidekick or our partners

We may also collect technical information automatically through cookies and tracking pixels (see section 12), and we may source limited information from publicly available records where lawful.

If you provide us with information about another person (for example, a co-owner or spouse), you must make sure they are aware of this policy and how their information will be used.

We collect and use your personal information for these purposes:

Primary purpose. To provide the guide, resource, or service you requested, and to communicate with you about that request.

Secondary purposes, each subject to your separate consent:

  • To share your details with a local Seller Sidekick approved real estate agent so they can contact you about a free home value update and selling consultation (see section 6)

  • To send you marketing communications from Seller Sidekick by email and SMS about selling your home, including market updates, insights, and offers

  • To improve our guides, services, and advertising, and to understand which campaigns are most useful

  • To comply with our legal obligations and manage any legal or commercial disputes

You can consent to none, one, or both of the secondary purposes. The primary purpose runs regardless. If we ever want to use your information for a purpose not described here, we will update this policy and apply the change only to information collected after the update.

6. Sharing your details with real estate agents (consent based)

This is the core of how Seller Sidekick works, so we set it out in full.

6.1 We only share with your express consent. When you complete a Seller Sidekick form, you will see a clearly worded, separate, unticked consent option that says words to this effect:

"I consent to Seller Sidekick sharing my details with a local Seller Sidekick approved real estate agent, who may contact me by phone, SMS or email for up to 12 months to offer a free home value update and selling consultation. I can opt out any time."

If you tick yes, you are giving us your express consent to forward your name, contact details, and property location to one local approved agent. If you do not tick it, we will not share your details with any agent.

6.2 What we share and with whom. We share your name, email, phone number, and property suburb or postcode with one licensed real estate agent operating in your area who is part of the Seller Sidekick approved agent network. We share your details with that one agent only. We do not broadcast your details to multiple agents.

6.3 What the agent may do. The agent may contact you by phone, SMS, or email to offer a free, no-obligation home value update and a selling consultation. The agent contacts you on behalf of Seller Sidekick and will identify themselves, their agency, and Seller Sidekick at the start of any call.

6.4 How long your consent lasts. Your consent to be contacted lasts for 12 months from the date you give it, unless you opt out earlier. We specify this 12-month period so that your consent remains valid under the Do Not Call Register Act 2006 (Cth), which would otherwise treat consent as expiring after 3 months.

6.5 Agent obligations. Every Seller Sidekick approved agent has signed an agreement requiring them to comply with the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), the Do Not Call Register Act 2006 (Cth), and, for New Zealand contacts, the Privacy Act 2020 (NZ) and the Unsolicited Electronic Messages Act 2007 (NZ). Agents must keep your information confidential, must only use your details for the purpose you consented to, must honour your opt-out requests, and must not resell, share, or independently market to you using your details.

6.6 You can withdraw at any time. You can withdraw your consent to agent contact at any time using any of the methods in section 7. Once you withdraw, we notify the agent and suppress your details so you are not contacted again through the Seller Sidekick network.

6.7 How we benefit. Seller Sidekick may receive a referral fee or commission from an agent if you engage that agent or sell your property through them. This does not cost you anything and does not change the obligations the agent owes you.

7. How to opt out or withdraw consent

You can opt out of marketing, agent contact, or both at any time by:

  • Clicking the unsubscribe link in any marketing email

  • Replying STOP to any SMS

  • Emailing us at info@sellersidekick.com.au

  • Telling the agent directly that you do not wish to be contacted further

We will action your request within 5 business days and confirm it once done. We may need to verify your identity before processing your request.

8. Direct marketing

We may contact you with marketing about Seller Sidekick's own products and services by email and SMS, but only where you have consented. Every marketing message includes a simple way to opt out.

We do not allow agents or any other third party to use your information for their own independent marketing. Agents may only contact you for the specific home value update and selling consultation purpose you consented to.

9. Meta lead data and platform compliance

Where we collect your data through Meta (Facebook or Instagram) Lead Ads or similar advertising platforms:

  • We comply with Meta's Lead Ads Terms and applicable data protection requirements

  • Your lead data is used solely to fulfil the request for which it was collected (for example, to send your guide and, if you consented, to connect you with a local agent)

  • We do not upload your lead data to Meta or any other advertising platform for targeting, remarketing, or to create custom or lookalike audiences

  • Agents who receive your data are contractually bound to use it only for your requested purpose and may not resell or share it

10. Who else we share information with

Aside from approved real estate agents (section 6), we may share your personal information with:

  • Our service providers, who help us operate, including advertising, customer relationship management, workflow automation, email and SMS delivery, hosting, payment processing, and AI-assisted processing. They only access your information to perform services for us, under confidentiality and data protection obligations

  • Professional advisers, such as lawyers and auditors

  • Regulators, law enforcement, or other parties where required or authorised by law

We require all third parties to keep your information confidential and to use it only for the purpose it was provided. We do not sell your personal information, and we do not share it with unrelated third parties for their own marketing.

11. Overseas disclosure

Some of our service providers store or process data outside Australia and New Zealand, primarily in the United States. Before disclosing information overseas, we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles and the New Zealand Information Privacy Principles. By submitting your information, you acknowledge this overseas handling.

12. Cookies, tracking, and third-party links

Our websites and landing pages may use cookies and tracking pixels, including the Meta Pixel, to measure advertising performance and understand how visitors use our content. We may collect non-identifiable data such as IP address, pages visited, and browser type. You can disable cookies in your browser settings, though some functionality may be affected.

Our content may link to third-party sites such as Facebook, Instagram, and TikTok. We are not responsible for their privacy practices. Please review their privacy policies before providing personal information to them.

13. How long we keep your information

We keep your personal information only as long as needed for the purposes in this policy, or as required by law:

  • If you only request a guide and do not opt in to anything further, we keep your information for 12 months

  • If you opt in to marketing, we keep it while you remain subscribed, plus 12 months after you unsubscribe for compliance records

  • If you opt in to agent contact, we keep it for the 12-month consent period, plus up to 7 years afterward to meet tax and commercial record-keeping obligations

We keep records of the consents you give, including when, how, and in what words, to meet our obligations under the Spam Act 2003 (Cth) and the Privacy Act 1988 (Cth).

14. Security

We take reasonable steps to protect your personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure. These include encrypted transmission and storage, restricted system access, and regular review of our providers' security. No system is completely secure. If a data breach occurs that is likely to cause serious harm, we will notify affected individuals and the relevant regulator (the OAIC in Australia or the Office of the Privacy Commissioner in New Zealand) as required.

15. Your rights

You have the right to:

  • Access the personal information we hold about you

  • Correct information that is inaccurate, incomplete, or out of date

  • Opt out of marketing and withdraw consent to agent contact

  • Request deletion of your information, subject to legal retention obligations

  • Ask us where we obtained your information, if not collected directly from you

  • Make a complaint if you believe we have mishandled your information

16. For New Zealand residents

If you are in New Zealand, the New Zealand Privacy Act 2020 applies to how we handle your information. In addition to the rights above:

  • When a Seller Sidekick approved agent receives your details from us, that agent will tell you that your information was received from Seller Sidekick, and how to access this policy and opt out. This satisfies the indirect collection notification requirement under IPP 3A, effective 1 May 2026

  • You can complain to the New Zealand Office of the Privacy Commissioner if you are not satisfied with how we handle your information (see section 17)

17. Complaints

If you believe we have mishandled your personal information, contact us first at info@sellersidekick.com.au and we will investigate and respond within 30 days.

18. Children

Seller Sidekick is not directed at people under 18 and we do not knowingly collect their information. If you believe we have, contact us and we will delete it.

19. Changes to this policy

We may update this policy from time to time. The current version always lives at this URL, and the "Last updated" date shows when it last changed. We will tell subscribers about material changes by email.
